{"id":5402,"date":"2026-06-30T17:23:47","date_gmt":"2026-06-30T17:23:47","guid":{"rendered":"https:\/\/www.worldwatchalert.com\/?p=5402"},"modified":"2026-06-30T17:23:49","modified_gmt":"2026-06-30T17:23:49","slug":"ihc-reserves-verdict-on-pleas-over-imran-bushras-alleged-solitary-confinement","status":"publish","type":"post","link":"https:\/\/www.worldwatchalert.com\/?p=5402","title":{"rendered":"IHC reserves verdict on pleas over Imran, Bushra\u2019s alleged solitary confinement"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>ISLAMABAD:<\/strong> <strong>The Islamabad High Court (IHC) on Tuesday reserved its verdict on the maintainability of petitions challenging the alleged solitary confinement of jailed PTI founder Imran Khan and his wife, Bushra Bibi.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A day earlier, the IHC had removed the registrar office\u2019s objections to the petitions, directing that both be formally numbered while leaving the question of maintainability to the judicial side. The hearing was then adjourned until Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When proceedings resumed, Justice Khadim Hussain Soomro reserved the order after hearing detailed arguments from counsel representing the petitioners and the National Accountability Bureau (NAB).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barrister Salman Safdar, appearing for the petitioners, said he would first address the petition filed by Bushra Bibi\u2019s daughter, Mubashara Khawar Maneka. Noting that he also had to appear before a division bench later in the day, he requested permission to conclude his arguments quickly. Justice Soomro responded with a smile, saying, \u201cWe have also sacrificed our tea.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petitions were filed by Aleema Khan on behalf of Imran Khan and by Mubashara Khawar Maneka on behalf of Bushra Bibi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barrister Safdar argued that both the Lahore High Court (LHC) and the IHC had previously relied on the Begum Shamim Afridi case in matters relating to solitary confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Addressing objections raised earlier by the NAB prosecutor during proceedings in the \u00a3190 million case appeals, Safdar denied ever seeking relief specifically regarding solitary confinement. He presented the record of a miscellaneous application filed in those appeals, saying it had only sought signatures on a power of attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is no mention of solitary confinement in that application or in the written order passed that day,\u201d he argued, adding that references to solitary confinement appeared only in the background section because applications seeking suspension of sentence were pending at the time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Safdar further contended that Bushra Bibi\u2019s case was unprecedented, describing it as the first known instance in Pakistan of a female prisoner allegedly being subjected to prolonged solitary confinement. He said she had been moved to Bani Gala after her conviction and confined to a room despite having no trial or remand proceedings pending against her.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When Justice Soomro asked whether he had recently met his clients, Safdar replied that he had met Imran Khan during a court-authorised visit but had not been allowed to meet Bushra Bibi for the past seven months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to an earlier judgment by Justice Miangul Hassan Aurangzeb concerning Bushra Bibi, Safdar argued that her situation had remained unchanged. He also cited the United Nations Standard Minimum Rules for the Treatment of Prisoners, also known as the Nelson Mandela Rules, claiming that the 74-year-old Imran Khan had lost vision in one eye, had been taken to hospital five times, and was being held in solitary confinement for 22 hours a day without access to newspapers, television or regular meetings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He further alleged that Bushra Bibi was being kept alone for 24 hours a day despite both she and Imran Khan having undergone eye surgeries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the petitioners concluded their arguments, NAB prosecutor Rafay Maqsood addressed the court on the issue of maintainability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He argued that the petitions were not maintainable, saying the earlier judgment by Justice Aurangzeb was distinguishable because it had been filed by Bushra Bibi herself, whereas the current petitions had been submitted by her daughter and Imran Khan\u2019s sister.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecutor also argued that the Begum Shamim Afridi case involved detainees who had not been convicted, whereas the present matter related to convicted prisoners serving sentences at Adiala Jail in a financial corruption case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to the Nusrat Bhutto case, Maqsood said it arose during martial law and dealt with constitutional issues under Article 184(3), making it inapplicable to the current proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He further maintained that neither Aleema Khan nor Mubashara Khawar Maneka qualified as aggrieved persons and therefore lacked the legal standing to invoke the constitutional jurisdiction of the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Responding to a question from the bench, the NAB prosecutor categorically denied that either Imran Khan or Bushra Bibi was being held in solitary confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is no solitary confinement, absolutely not,\u201d he told the court. He added that the petitioners had failed to first approach jail authorities or exhaust alternative remedies available under prison rules before invoking Article 199 of the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maqsood argued that prison rules adequately regulate the treatment of convicted prisoners and said the allegations were unsupported by any independent evidence. He maintained that regular meetings with the prisoners had continued over the past year and alleged that the petitioners were attempting to secure, through these petitions, relief that had already been declined in previous proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In rebuttal, Barrister Safdar argued that the NAB prosecutor was defending the jail authorities instead of limiting his arguments to NAB\u2019s role. He maintained that the court had previously made observations regarding Bushra Bibi\u2019s confinement and insisted that the precedents cited by the prosecution did not restrict the court\u2019s constitutional authority to examine allegations of unlawful solitary confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After hearing arguments from both sides, Justice Soomro reserved the verdict on the admissibility of the petitions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her petition filed last week, Aleema Khan described her brother\u2019s detention conditions as unlawful and inhumane. She said that during a lawyers\u2019 meeting on April 8, it emerged that Imran Khan had allegedly been kept in solitary confinement for 22 hours a day, while Bushra Bibi was allegedly confined in isolation for 24 hours daily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mubashara Khawar Maneka\u2019s petition similarly alleged that her mother was being unlawfully held in solitary confinement and requested the court to declare the confinement illegal and set it aside.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imran Khan has been imprisoned since August 5, 2023, and is serving a 14-year sentence at Rawalpindi\u2019s Adiala Jail in the \u00a3190 million case, also known as the Al-Qadir Trust case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On January 17, 2025, an accountability court in Islamabad sentenced Imran Khan and Bushra Bibi to 14 and seven years in prison, respectively.
